English essay - Should the death penalty for all murders? ( part )

Relative of the dead will call for death penalty for the suspect. " An eye for an eye, a tooth for a tooth." This is the way how people think of. Therefore, when one humen kill another humen in the society. Voice of calling for death penalty is very common. But, death penalty sould not be mandatory for all murderers.

First, what is the definition of "murder"? Usually the defintion given off by people will be "when one humen kill another humen".  This definition maybe a bit hasty that there are tones of example as "when one humen kill another humen".  As a reult, the killing of another human being under conditions specifically covered in law. "In the U.S., special statutory definitions include murder committed with malice aforethought, characterized by deliberation or premeditation or occurring during the commission of another serious crime, as robbery or arson (first-degree murder), and murder by intent but without deliberation or premeditation (second-degree murder). "  (Dictionary.com Unabridged (v 1.1),Based on the Random House Unabridged Dictionary) This definition tell us the first reason why
death penalty sould not be mandatory for all murderers. There are different states of  " murder", the first-degree murder and the second-degree murder.

Now a days, our law is usually base on the relious rule

Also in some of the special cases, the "suspsct" is not the actual murderer.
